1. DEFINITIONS
For the purposes of these General Terms and Conditions of Sale on the website www.humboldtbooks.com, and in addition to the other definitions provided therein, the following terms shall have the meanings set out below:
1.1 “General Terms and Conditions”: all the terms of sale on the website www.humboldtbooks.com, applicable to the contractual relationship between Humboldt Books and the Customer.
1.2 “Humboldt Books”: a trademark of Humboldt S.r.l., owner of the website www.humboldtbooks.com, which intends to sell via the Internet the products belonging to its range. VAT no. 07739490964, Companies Register no. MI1978824.
1.3 “Products”: books or gadgets forming part of its product range.
1.4 “Customer”: the purchaser of the Products who qualifies as a consumer, meaning a natural person buying for purposes unrelated to any commercial or professional activity carried out.
1.5 “Website”: all web pages relating to the www.humboldtbooks.com site.
2. SCOPE OF APPLICATION
2.1 The General Terms and Conditions form an integral part of any proposal, purchase order and purchase order confirmation for the Products sold on www.humboldtbooks.com, in force on the date of the relevant order.
2.2 The General Terms and Conditions concern exclusively sales to Customers acting as consumers, as specified above.
3. CONTRACT FORMATION
3.1 All contracts are concluded exclusively through the Customer’s access to the Website, using remote communication technology via the Internet.
3.2 All purchase orders submitted to Humboldt Books must be completed in full and must contain all the elements necessary for the identification of the ordered Products, the Customer, and the delivery address.
3.3 The purchase order sent to Humboldt Books constitutes the Customer’s contractual proposal made online.
3.4 The order confirmation by Humboldt Books, sent to the Customer at the email address provided, confirms the order details and constitutes acceptance of the contractual proposal.
3.5 The contract is deemed concluded, and binding on both parties, when the order confirmation is sent to the Customer.
3.6 Humboldt Books reserves the right not to accept incomplete or improperly completed orders.
4. DELIVERY TIMES AND METHODS
4.1 Humboldt Books will deliver to the Customer the selected and ordered Products, as per the above article, using trusted couriers and/or shippers or via the postal service.
4.2 Delivery times, pursuant to Art. 6 of Legislative Decree No. 185/1999, shall not exceed 30 days from the day following the submission of the order to Humboldt Books.
4.3 Delivery of the Products is subject to the Customer’s payment of the relevant price using one of the methods made available by Humboldt Books.
5. PRICES
5.1 All Product prices indicated on the Website are expressed in Euros.
5.2 Unless otherwise specified, Product prices include VAT and any other tax.
5.3 The prices of individual Products indicated on the Website from time to time cancel and replace any previously indicated prices.
5.4 The applicable prices are those shown on the Website at the time the Customer places the purchase order.
6. PRODUCT FEATURES AND AVAILABILITY
6.1 Products are not supplied on approval. The Customer is responsible for selecting the Products ordered and for ensuring that they meet his or her needs.
7. LIABILITY OF HUMBOLDT BOOKS
7.1 Humboldt Books accepts no liability for service disruptions due to force majeure of any kind, should it be unable to perform the contract within the agreed time. Examples of force majeure include, without limitation, measures taken by public authorities, strikes by its employees or by carriers used by Humboldt Books, as well as any other circumstance beyond its control.
8. CUSTOMER OBLIGATIONS
8.1 Once the online purchase procedure has been completed, the Customer undertakes to print and retain these General Terms and Conditions.
8.2 The information contained in the General Terms and Conditions must be viewed and accepted by the Customer prior to sending the purchase order, so as to fully satisfy the conditions set out in Art. 3 and 4 of Legislative Decree No. 185/1999.
9. RIGHT OF WITHDRAWAL
9.1 Pursuant to Art. 5 of Legislative Decree No. 185/1999, the Customer who, for any reason, is not satisfied with the purchase made, has the right to withdraw from the contract and return the Products that may have already been delivered, without penalty and without providing a reason.
9.2 The right of withdrawal must be exercised by the Customer, under penalty of forfeiture, by sending a registered letter with return receipt to Humboldt Books, Via San Marco 33, 20121 Milan (Italy), within the time period established by law.
9.3 The above communication may also be sent within the same period by fax, provided that it is confirmed by registered letter with return receipt within 48 hours of sending the fax.
9.4 The Customer may not exercise the right of withdrawal for customised products.
9.5 If withdrawal is exercised in accordance with the conditions set out above, the amount paid for the Products and for shipping costs, where the goods have not yet been delivered, will be refunded to the credit card used for the purchase.
9.6 The refund is free of charge and will be made as soon as possible, and in any case within 30 days from the date on which Humboldt Books becomes aware of the Customer’s exercise of the right of withdrawal.
9.7 Within 10 working days of exercising the right of withdrawal, the Customer must return the Products to the address of Humboldt Books.
9.8 Returned Products must be intact, unused, and in their original packaging.
9.9 The only costs payable by the Customer for exercising the right of withdrawal are the direct costs of returning the Products to Humboldt Books.
9.10 Cash-on-delivery or carriage-forward parcels will not be accepted under any circumstances.
10. PAYMENT AND SHIPPING METHODS
10.1 The Customer may pay for the ordered Products using:
Credit card via Stripe (www.stripe.com): this method involves the encrypted transmission of data at 128 bits via an SSL3 (Security Socket Layer) connection, ensuring maximum security in data transfer. SSL3 is currently the highest, internationally recognised security standard, making Internet purchases by credit card safe. Credit card data are not accessed by third parties but solely by Stripe, which charges the card only when the order is ready for dispatch.
10.2 By completing the designated space on the Website, the Customer authorises Humboldt Books to use the payment methods requiring prior debit authorisation.
10.3 Shipping costs will be calculated according to the delivery location. Once the address has been entered, a full order summary, including shipping costs, will appear. At that point, the Customer may proceed to select the payment method.
11. PRODUCT WARRANTY
11.1 Humboldt Books guarantees that the delivered Products correspond to those indicated on the Website, but accepts no liability regarding the quality, packaging, or labelling of products not manufactured by it, without prejudice to the Customer’s right of withdrawal. Humboldt Books guarantees only the material integrity of the Product packaging at the moment of delivery.
11.2 Regarding Products packaged and labelled by Humboldt Books, it assumes responsibility solely for the packaging and compliance with applicable labelling regulations.
11.3 Any defects must be reported by the Customer, under penalty of forfeiture, within 14 days from the date of delivery. The Customer has the right to request and obtain the collection and replacement only of those items that prove damaged upon delivery and/or incorrectly labelled; the Customer has no right to compensation for any damage. Replacement costs are borne by Humboldt Books.
12. DISPUTES
12.1 Any dispute relating to the application, execution, interpretation and breach of the online contract entered into by the Customer with Humboldt Books is subject to Italian jurisdiction.
12.2 For any dispute between the parties, the competent court shall be the Court of Milan, if located within Italian territory.
12.3 If the Customer’s domicile or residence is outside Italian territory, the competent court shall be that of the place where the contract is performed.
